1. Introduction

1.1. This promotional offer (the “Offer”) is run by Thomas Cook Tourism (UK) Company Limited, incorporated in England and Wales with registered company number 12211539 (“Thomas Cook”) and Silver Cross (UK) Limited with registered company number 4611579] (“Silver Cross”) (together referred to as the “Promoter”) and is open to all residents of the United Kingdom and Northern Ireland over the age of 18 years who are lead passengers in a Family Holiday booking (defined below), except for (a) the directors, members, partners, agents, consultants or employees of the Promoter and their immediate families, (b) the directors, members, partners, agents, consultants or employees of any suppliers of any goods or services to the Promoter in respect of this Offer, or (c) directors, members, partners, agents, consultants or employees of the Promoter’s advertising and promotion agencies, associated companies, and participating outlet owners and staff.

1.2. The rules set out in this document constitute the rules which will govern the Offer (“Offer Terms and Conditions”).

1.3. Participation in the Offer by all entrants (“Participants”) constitutes and will be deemed acceptance of these Offer Terms and Conditions.


2. Promotional Offer Period

This Offer will run from 28 December 2022 until 31 January 2023 or until Thomas Cook provides a public notice that the Offer has ended, whichever is earlier (“Offer Period”). Participation will only be accepted during the Offer Period.


3. Promotion Process

3.1. This Offer will take place on:
3.1.1. Thomas Cook’s official Instagram and Facebook pages; and
3.1.2. Silver Cross’ official Instagram and Facebook pages, on the Edit (available at https://www.silvercrossbaby.com/the-edit/) and via email to its existing customer base,
(together referred to as the “Platforms”).

3.2. During the Offer Period, in order to receive the Promotional Item, a Participant must book a qualifying family holiday with Thomas Cook, on the terms set out below (the “Family Holiday”) and enter the promotional code found on the Platforms during the checkout process.

3.3. Each Family Holiday must:
3.3.1. be booked directly with Thomas Cook via thomascook.com during the Offer Period;
3.3.2. take place between 1 May 2023 and 31 October 2023 (both dates inclusive);
3.3.3. include, as passengers in the booking, at least one adult (any person over the age of 18 years) and one child (any person under the age of 18 years, which includes an infant) in the booking;
3.3.4. have a minimum spend of £2,000;
3.3.5. be paid in full not less than 30 days prior to departure; and
3.3.6. be booked from the United Kingdom or Northern Ireland, with the Participant sharing their residential address within the United Kingdom or Northern Ireland with the Promoter during the booking process.


4. Description of the Promotional Item

4.1. The Promotional Item for this Offer as follows (the “Promotional Item”): 1 x Black Silver Cross Jet3 Stroller (https://www.silvercrossbaby.com/prams-pushchairs/strollers/jet/ ).

4.2. Upon successful verification of the Participant and full payment of the Family Holiday, the Participant shall receive the Promotional Item.

4.3. There are two hundred (200) Promotional Items to be given away.

4.4. Use of the Promotional Item may be subject to additional terms and conditions, as specified by Silver Cross from time to time.

4.5. Silver Cross will, at its own cost, deliver the Promotional Item to the Participant(s) within 21 days of final payment of the qualifying booking. The Participants must, on request, provide the Promoter with a physical address within the United Kingdom or Northern Ireland for delivery of the Promotional item.

4.6. No Promotional Item, in whole or in part, can be transferred to any other person or exchanged for an alternate item or for its cash value. A Participant may not substitute him/herself with any other person.


5. Verification

5.1. The Promotional Item will only be provided after successful verification of the Participant(s).

5.2. The Promoter reserves the right to carry out audits in respect of any Participant (s) to verify their eligibility and/or the validity of the Participant (s) entry. The Promoter may disqualify any Participant (s) if any fraud or cheating or related activity is suspected, including without limitation, through the manipulation of entries or otherwise falsifying data. All entries, participants or travel partners determined by the Promoter or their agents to be invalid or ineligible will forfeit all rights to any Promotional Item and will not be compensated in any way.


6. Promotional Item Forfeiture

6.1. The Participant(s) must communicate his/her full details to the Promoter or its agent as requested by the Promoter or its agent. Failure to do so may result in forfeiture of the Promotional Item.

6.2. If a Participant is unable to receive the Promotional Item then the entire Promotional Item shall be forfeited. There will be no compensation, in any form, including, but not limited to monetary compensation and/or rescheduling, to any party, irrespective of the reason/s for the inability of that Participant to receive or utilise (as applicable) the Promotional Item.


7. General

7.1. In the event of a dispute, the Promoter’s decision is final and binding and no correspondence will be entered into.

7.2. The timelines stated by the Promoter or its agent must be adhered to. Failing adherence to any timeline, at any stage, may result in disqualification and forfeiture of the Promotional Item in its entirety with no compensation to any party by the Promoter.

7.3. The Promoter will not share any personal information with any third party except where such disclosure is necessary to enable the Promoter to provide, deliver or in any other way give effect to these Offer Terms and Conditions and/or the Promotional Item, where such disclosure is (i) in accordance with the Promoter’s privacy policy available at https://www.silvercrossbaby.com/about-silver-cross/privacy-policy/, and https://www.thomascook.com/privacy-policy/ and (ii) as permitted by law, including where consent to the Promoter sharing personal information is obtained from the Participant(s). By entering the Offer, each Participant hereby consents to the Promoter’s use of their personal information, but solely for the purposes contemplated in these Offer Terms and Conditions and in accordance with this paragraph 7.3.

7.4. The Promoter may make media announcements or publish the names and/or photographs of the Participant without remuneration being made payable to the Participants provided that any such person may expressly elect to decline this by written communication to the Promoter.

7.5. Should the Promotional Item not be available despite the Promoter’s reasonable endeavours to procure the Promotional Item, the Promoter reserves the right to substitute the Promotional Item with another of equal value as determined in the Promoter’s sole discretion and subject to availability. No person will be compensated in any way in this instance by the Promoter.

7.6. The Promoter will not be responsible for any costs, expenses or other liabilities incurred by the Participants which are not expressly contemplated as part of the Promotional Item.

7.7. These Offer Terms and Conditions may be amended by the Promoter on public notice at any time during the Offer Period or thereafter. These Offer Terms and Conditions will be interpreted by the Promoter only.

7.8. The Promoter reserves the right to alter, amend or cancel this Offer in whole or in part. Any alterations, amendments or cancelations will be interpreted by the Promoter only. In the event of an alteration, amendment and/or cancellation the Promoter will not compensate any individual for any reason whatsoever.

7.9. Each Participant represents, warrants and undertakes that it shall not nor shall any entry:
7.9.1. disparage the Offer, the Promoter or any member of the Promoter’s group in any way;
7.9.2. violate a third party’s rights, including intellectual property rights;
7.9.3. harass, bully or unlawfully discriminate against Promoter personnel or third parties;
7.9.4. make false or misleading statements;
7.9.5. contain content which is inappropriate, indecent, hateful or defamatory;
7.9.6. promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
7.9.7. breach any applicable law.
7.10. The Promoter may immediately disqualify any entry and remove any content which it determines contravenes or may contravene these Offer Terms and Conditions (including paragraph 8.10 above). All Participants hereby indemnify and hold harmless the Promoter, its respective associated companies (directors, officers and employees) and agents, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever connected to or arising out of their participation in any way in this Offer or their receipt, participation, ownership and/or use of the Promotional Item. This indemnity is not intended to exclude any liability for any person which cannot be excluded by applicable law.

7.11. The Promoter shall not be responsible for any lost, damaged, corrupted, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending an entry will not be accepted as proof of receipt of such entry. The Promoters shall not be responsible for the failure of any technical element relating to this Offer that may result in an entry not being successfully submitted. The Promoter is not responsible for lost, damaged or delayed entries as a result of any network, computer or mobile phone hardware or software failure of any kind. No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted. Entries will only be accepted if they comply with all entry instructions. Any form of network or systems manipulation including but not limited to Botnets, Sim Farms, Trojans, SMS malware may not be used when entering the Offer.

7.12. By participating in the Offer each Participant will be asked to opt in to Thomas Cook marketing its products and campaigns to the Participant, and where the Participant opts in Thomas Cook shall be entitled to use the details provided by the Participant for these purposes.

7.13. The Promoter shall not be in breach of these Offer Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations if such delay or failure result from events, circumstances or causes beyond its reasonable control.

7.14. These Offer Terms and Conditions and any non-contractual rights or obligations arising out of or in relation to them, shall be governed by and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the English courts for any dispute arising in connection with the Offer Terms and Conditions or the Offer.
